28 C.F.R. § 71.52 — Approval of Agency requests to initiate a proceeding.

§ 71.52 Approval of Agency requests to initiate a proceeding. (a) The Assistant Attorney General of the Civil Division is authorized to act on notices by an agency submitted to the Department of Justice pursuant to 31 U.S.C. 3803(a)(2) and, pursuant to the provisions of section 3803(b), to approve or disapprove the referral to an agency's presiding officer of the allegations of liability stated in such notice. (b) The Assistant Attorney General of the Civil Division may (1) Require additional information prior to acting as set forth above, in which case the 90 day period shall be extended by the time necessary to obtain such additional information; and (2) Impose limitations and conditions upon such approval or disapproval as may be warranted in his or her judgment.
