§ 29.930 May the Department or the Tribe appeal the decision of an administrative law judge? (a) The decision of an administrative law judge is a recommended decision that the Department or the Tribe may appeal to the Secretary. (b) The decision of an administrative law judge becomes the final decision of the Secretary 60 days after it is served on the Department and the Tribe unless a petition for review is filed in accordance with § 29.931. The decision of the Secretary is a final agency action that the Tribe may appeal to the U.S. District Courts.
