40 C.F.R. § 35.688 — Award limitations.

§ 35.688 Award limitations. (a) Initial grants. The Regional Administrator will not make an initial award unless the Tribe or each member of the Intertribal Consortium has: (1) Met the requirements of § 35.676 (Eligible recipients); and (2) Established an approved underground water source protection program or agrees to establish an approvable program within four years of the initial award. (b) Subsequent grants. The Regional Administrator will not make a subsequent grant, after the initial award, unless the Tribe can demonstrate reasonable progress towards assuming primary enforcement responsibility within the four-year period after initial award. After the four-year period expires, the Regional Administrator shall not award section 1443(b) funds to an Indian Tribe unless the Tribe has assumed primary enforcement responsibility for the underground water source protection program.
