40 C.F.R. § 35.686 — Eligible recipients.

§ 35.686 Eligible recipients. A Tribe or Intertribal Consortium is eligible to apply for an underground water source protection grant if the Tribe or each member of the Intertribal Consortium meets the following criteria: (a) The Tribe or each member of the Intertribal Consortium is recognized by the Secretary of the Interior; (b) The Tribe or each member of the Intertribal Consortium has a governing body carrying out substantial governmental duties and powers over any area; (c) The functions to be exercised under the grant are within the area of the Tribal government's jurisdiction; and (d) The Tribe or each member of the Intertribal Consortium is reasonably expected to be capable, in the Regional Administrator's judgment, of carrying out the functions to be exercised under the grant.
