§ 404.111 When we consider a person fully insured based on World War II active military or naval service. We consider that a person, who was not otherwise fully insured, died fully insured if— (a) The person was in the active military or naval service of the United States during World War II; (b) The person died within three years after separation from service and before July 27, 1954; and (c) The conditions in § 404.1350 that permit us to consider the person fully insured are met. (d) The provisions of this section do not apply to persons filing applications after May 31, 1992, unless a survivor is entitled to benefits under section 202 of the Act based on the primary insurance amount of the fully insured person for the month preceding the month in which the application is made.
