§ 41.11 Who is eligible for financial assistance under this subpart? (a) A Tribal college or university is eligible for financial assistance under this subpart only if it: (1) Is governed by a board of directors or board of trustees, a majority of whom are Indians; (2) Demonstrates adherence to stated goals, a philosophy, or a plan of operation directed to meet the needs of Indians; (3) Has a student body that is more than 50 percent Indian (unless it has been in operation for less than one year); (4) Is either: (i) Accredited by a nationally recognized accrediting agency or association determined by the Secretary of Education to be a reliable authority with regard to the quality of training offered; or (ii) Is making reasonable progress toward accreditation according to such agency or association; (5) Has received a positive determination after completion of an eligibility study; and (6) Complies with the requirements of § 41.19. (b) Priority in grants is given to institutions that were in operation on October 17, 1978, and that have a history of service to Indian people.
