25 C.F.R. § 162.239 — How will payment rights and obligations relating to agricultural land be allocated between the Indian landowners and the tenant?

§ 162.239 How will payment rights and obligations relating to agricultural land be allocated between the Indian landowners and the tenant? (a) Unless otherwise provided in an agricultural lease, the Indian landowners will be entitled to receive any settlement funds or other payments arising from certain actions that diminish the value of the land or the improvements thereon. Such payments may include (but are not limited to) : (1) Insurance proceeds; (2) Trespass damages; and (3) Condemnation awards. (b) An agricultural lease may provide for the tenant to assume certain cost-share or other payment obligations that have attached to the land through past farming and grazing operations, so long as those obligations are specified in the lease and considered in any determination of fair annual rental made under this subpart.
