16 C.F.R. § 1101.62 — Statutory exceptions to section 6(b)(5) requirements.

§ 1101.62 Statutory exceptions to section 6(b)(5) requirements. (a) Scope. The limitations established by section 6(b)(5) do not apply to the public disclosure of: (1) Information with respect to a consumer product which is the subject of an action brought under section 12 ( see § 1101.42); (2) Information with respect to a consumer product which the Commission has reasonable cause to believe is in violation of any consumer product safety rule or provision under the Consumer Product Safety Act (Pub. L. 92–573, 86 Stat. 1207, as amended (15 U.S.C. 2051, et seq. )) or similar rule or provision of any other act enforced by the Commission; or (3) Information in the course of or concerning a judicial proceeding ( see § 1101.45).
