15 C.F.R. § 904.403 — Review and appeal of a written warning.

§ 904.403 Review and appeal of a written warning. (a) [Reserved] (b) The recipient of a written warning may appeal to the NOAA Deputy General Counsel. The appeal must be served in conformance with § 904.3 and submitted to administrative.appeals@noaa.gov or the NOAA Office of the General Counsel, Herbert Hoover Office Building, 14th & Constitution Avenue NW, Washington, DC 20230, within 60 days of receipt of the written warning. (1) An appeal from a written warning must be in writing and must present the facts and circumstances that explain or deny the violation described in the written warning. (2) [Reserved] (c) The NOAA Deputy General Counsel may, in his or her discretion, affirm, vacate, or modify the written warning and will notify the respondent of the determination. The NOAA Deputy General Counsel's determination constitutes the final agency action. [71 FR 12448, Mar. 10, 2006, as amended at 87 FR 38942, June 30, 2022]
