§ 904.403 Review and appeal of a written warning. (a) [Reserved] (b) The recipient of a written warning may appeal to the NOAA Deputy General Counsel. The appeal must be served in conformance with § 904.3 and submitted to administrative.appeals@noaa.gov or the NOAA Office of the General Counsel, Herbert Hoover Office Building, 14th & Constitution Avenue NW, Washington, DC 20230, within 60 days of receipt of the written warning. (1) An appeal from a written warning must be in writing and must present the facts and circumstances that explain or deny the violation described in the written warning. (2) [Reserved] (c) The NOAA Deputy General Counsel may, in his or her discretion, affirm, vacate, or modify the written warning and will notify the respondent of the determination.
