Purpose and scope.

§ 609.1 Purpose and scope. (a) This part sets forth the policies and procedures that DOE uses for receiving, evaluating, and approving applications for loan guarantees to support Eligible Projects under section 1703 of the Energy Policy Act of 2005 (Act). (b) This part applies to all Applications, Conditional Commitments, and Loan Guarantee Agreements. (c) Part 1024 of chapter X of title 10 of the Code of Federal Regulations shall not apply to actions taken under this part. (d) This part incorporates the policies set forth in Executive Order 13953 (“Executive Order Addressing the Threat to the Domestic Supply Chain from Reliance on Critical Minerals from Foreign Adversaries,” dated September 20, 2020), and Executive Order 13817 (“A Federal Strategy to Ensure Secure and Reliable Supplies of Critical Minerals,” dated December 20, 2017), as amended.
