1-15-5-2: ACTION ON REQUEST:
A. Planning And Zoning Commission Recommendations: The commission shall review the request and any agency response and make a recommendation to the City for approval, conditional approval or denial.
B. City Action:
1. When considering an application for vacation procedures, the City shall establish a date for public hearing and give such public notice as required by law. The City may approve or deny the application. Whenever public rights-of-way or lands are vacated, the City shall provide adjacent property owners with appropriate assurances in the form of a quitclaim deed or other documents for said vacated rights-of-way in such proportions as are prescribed by law.
2. When considering an application for dedication, the City may approve or deny the application. When a dedication is approved, any required road or utility improvements shall be constructed prior to acceptance of the dedication. (Ord. 568, 12-21-2015; amd. Ord. 609, 7-3-2018)
