Prohibited Actions

TITLE 67 STATE GOVERNMENT AND STATE AFFAIRS CHAPTER 38 COMMERCIAL PROPERTY ASSESSED CAPITAL EXPENDITURE ACT 67-3814. prohibited actions. A local government that establishes a region, as defined in section 67-3803 , Idaho Code, shall not: (1)  Make the issuance of a permit, license, or other authorization from the local government to a person who owns property in the region contingent on the person entering into a written contract to repay the financing of a qualified project through special assessments pursuant to this chapter; or (2)  Otherwise compel a person who owns property in the region to enter into a written contract to repay the financing of a qualified project through special assessments.
