Idaho Code § 66-411 — Review And Discharge.

TITLE 66 STATE CHARITABLE INSTITUTIONS CHAPTER 4 TREATMENT AND CARE OF THE DEVELOPMENTALLY DISABLED 66-411. Review and discharge. (1) The head of each residential facility shall, following admission, examine or cause to be examined every resident, and determine whether to discharge each resident from the facility. A similar review shall be conducted annually thereafter. A report of each review and determination of every respondent committed to the director shall be sent to the committing court, respondent’s attorney, and either the respondent’s spouse, guardian, adult next of kin or friend, or if none, the respondent’s resident representative. (2)  Whenever it is determined that the respondent is no longer developmentally disabled or likely to injure himself or others, the director or his designee shall terminate the commitment and make a report thereof to the court which issued the order.
