Private Civil Enforcement Exclusive

TITLE 6 ACTIONS IN PARTICULAR CASES CHAPTER 38 LIABILITY FOR PUBLISHERS AND DISTRIBUTORS OF MATERIAL HARMFUL TO MINORS ON THE INTERNET 6-3807. PRIVATE CIVIL ENFORCEMENT EXCLUSIVE. (1) Notwithstanding any other provision of law to the contrary, the requirements of this chapter shall be enforced exclusively through the private civil actions described in section 6-3804 , Idaho Code. (2)  No direct or indirect enforcement of this chapter may be taken or threatened by the state, a political subdivision, a district or county attorney, or any officer or employee of this state or a political subdivision against any person or entity by any means. No violation of this section may be used to justify or trigger the enforcement of any other law or any type of adverse consequence under any other law, except as provided in this section. (3)  This section does not preclude or limit the enforcement of any other law or regulation against conduct that is independently prohibited by such other law or regulation and that would remain prohibited by such other law or regulation in the absence of this chapter.
