TITLE 40 HIGHWAYS AND BRIDGES CHAPTER 1 DEFINITIONS 40-113. Definitions — L. (1) "Lawfully maintained" means a sign maintained on private land in accordance with state law and with the consent or acquiescence of the owner, or his agent, of the property upon which the sign is located. (2)  "Local highway technical assistance council" means the public agency created in chapter 24, title 40 , Idaho Code. (3)  "Local highway jurisdiction" means a county with jurisdiction over a highway system, a city with jurisdiction over a highway system, or a highway district. (4)  "Lowest price technically acceptable selection" means a type of process for selection of a design-build firm in which the department identifies evaluation factors that establish the minimum requirements of acceptability. Proposals are evaluated for acceptability based on qualitative factors, not cost or price, but are not ranked. The contract award will be made on the basis of the lowest evaluated price of proposals meeting or exceeding the acceptability standards for qualitative factors.
