Idaho Code § 39-3622 — Enforcement Provisions.

TITLE 39 HEALTH AND SAFETY CHAPTER 36 WATER QUALITY 39-3622. Enforcement provisions. (1) The designated agency shall ensure that the approved outstanding resource water best management practices are implemented for new nonpoint source activities. If a person fails to obtain approval from a designated agency for a new nonpoint source activity as set forth in section 39-3620 , Idaho Code, or if a person fails to implement approved best management practices and water quality is lowered, the designated agency may institute a civil action for an immediate injunction to halt the activity or pursue other remedies provided by law. (2)  Nothing in this act shall restrict the enforcement authority of the department or designated agencies as provided by law.
