Denial Of Application Or Revocation Of A Certificate

TITLE 39 HEALTH AND SAFETY CHAPTER 35 IDAHO CERTIFIED FAMILY HOMES 39-3523. Denial of application or revocation of a certificate. (1) The department may deny any application for a certificate when persuaded by a preponderance of evidence that such conditions exist as to endanger the health or safety of any resident or when the applicant fails to demonstrate compliance with any provision of this chapter or rules promulgated pursuant to this chapter. The department may also deny any application for a certificate for any other cause for denial listed in rules promulgated by the department. (2)  The department may revoke any certificate when persuaded by a preponderance of evidence that such conditions exist as to endanger the health or safety of any resident or when the care provider violates any provision of this chapter or rule promulgated pursuant to this chapter after having been notified by the department of such violation and given an opportunity to make corrections as described in the rules promulgated pursuant to this chapter. The department may also revoke any certification for any other cause for revocation listed in rules promulgated by the department.
