Idaho Code § 26-3714 — Criminal Penalties.

TITLE 26 BANKS AND BANKING CHAPTER 37 IDAHO CONTINUING-CARE DISCLOSURE ACT 26-3714. Criminal penalties. (1) Any person who willfully and knowingly violates any provision of this chapter, or any rule or order under the chapter, shall be guilty of a misdemeanor and be sentenced to pay a fine of not more than one thousand dollars ($1,000) or imprisonment for not more than one (1) year in the county jail or both for each violation. (2)  The director may refer such evidence as is available concerning violations of the provisions of this chapter or of any rule or order hereunder to the attorney general or the proper prosecuting attorney who may, with or without such a reference, institute the appropriate criminal proceedings under this chapter. (3)  Nothing in this chapter limits the power of the state to punish any person for any conduct which constitutes a crime under any other statute.
