Idaho Code § 19-2312 — Conviction Of Included Offense.
TITLE 19 CRIMINAL PROCEDURE CHAPTER 23 VERDICT 19-2312. Conviction of included offense. The jury may find the defendant guilty of any offense, the commission of which is necessarily included in that with which he is charged in the indictment, or of an attempt to commit the offense.
