Idaho Code § 19-1718 — What Is A Former Acquittal.

TITLE 19 CRIMINAL PROCEDURE CHAPTER 17 PLEADINGS BY DEFENDANT 19-1718. What is a former acquittal. Whenever the defendant is acquitted on the merits he is acquitted of the same offense, notwithstanding any defect in form or substance in the indictment on which the trial was had.
