Idaho Code § 10-1206 — When Court May Refuse Judgment Or Decree.
TITLE 10 ISSUES, TRIAL AND JUDGMENT IN CIVIL ACTIONS CHAPTER 12 DECLARATORY JUDGMENTS 10-1206. When court may refuse judgment or decree. The court may refuse to render or enter a declaratory judgment or decree where such judgment or decree, if rendered or entered, would not terminate the uncertainty or controversy giving rise to the proceeding.
