TITLE 9 - FIRE REGULATIONS
SECTION:
The International Fire Code, as published and adopted by the State Fire Marshal, is the minimum standards for the protection of life and property from fire and explosions in the state of Idaho. The International Fire Code is enforced by the State Fire Marshal and by a fire protection district. (I.C. §§ 41-253,41-254 and 31-1417). The International Fire Code provides for plan review, structure inspection permits, and fees in accordance with the fee schedule established by the applicable governing body. The city does not have a fire department, and therefore the fire protection district is the applicable governing body to issue permits, conduct, plan review, and structure inspections pursuant to and under the authority of the International Fire Code. The city will not issue a building permit (KCC § 4-1-3) until the fire protection district's plan review fees (which is inclusive of structure inspections) have been paid. The city may enter into an agreement with a fire protection district to collect their plan review fees.

Notice Of Violation: Any person found violating any of these provisions contained in said codes adopted in section 9-1-1 of this chapter shall be served by the city with a written notice stating the nature of the violation and providing a time limit of five (5) days for the satisfactory correction thereof. The offender shall, within the period of time stated in such notice, permanently cease all violations.
B.
Liability For Costs: Any person violating any provisions of said codes adopted in this chapter shall be liable to the city for any expense, loss or damage occasioned the city by reason of such violation.
C.
Penalty: Any person who shall continue any violation beyond the time limit provided for in subsection A of this section shall be guilty of a misdemeanor, and on conviction thereof, shall be fined as provided for in section 1-4-1 of this code. A separate offense shall be deemed committed for each day in which any violation shall continue or occur.

There is hereby adopted for the purpose of regulating and controlling life safety of the city, the life safety code 101-2000 prepared by the National Fire Protection Association, 2000 edition thereof, and as the same may hereafter be revised or amended.

SECTION:
It shall be unlawful for any person to burn, incinerate, bury, dump, collect, remove or in any other manner dispose of rubbish or garbage inside the city limits. Nothing herein contained shall be construed to prohibit the use of outdoor fireplaces, barbecue pits or grills, tree trimmings or for recreational purposes. It shall also be unlawful for any person to burn trade waste of any kind, specifically debris leftover or found at construction sites which is piled together and burned in a bonfire like fashion.

When Ada County issues a clean air warning, no fireplaces which burn wood, wood stoves, or any wood burning shall be permitted within the city limits while the county warning is in effect, unless the fireplace or wood burning stove is the only source of heat in the residence or business.

The Kuna fire district shall have the authority to grant special burn permits for the burning of leaves, yard debris, and ditches provided the applicant first apply to the fire district for the permit and follow all regulations put forth by the fire district.

A violation of this chapter shall be punishable by an administrative citation.

SECTION:
There is hereby adopted for the purpose of regulating the possession, transfer and use of firecrackers and fireworks within the city, title 39, chapter 26, Idaho Code, otherwise known as the Idaho state fireworks law as it presently exists or as it may hereafter be revised or amended. The same is hereby adopted and incorporated as an ordinance of the city as fully as though set forth at length herein.
