SECTION:


For the purpose of carrying out the provisions of the zoning regulations of the city, a planning and zoning commission is hereby created. Said commission shall consist of five (5) voting members, all appointed by the mayor and confirmed by majority vote of the council. Appointed members of the commission must have resided in the county for two (2) years prior to his/her appointment, and must remain a resident of the county during his/her service on the commission. The term of office for members shall be three (3) years. No person shall serve more than two (2) full consecutive terms (six (6) years) unless the city council makes a specific motion for the reappointment of the commissioner and it passes by a two-thirds (2/3) vote and it is recorded in the minutes. Vacancies occurring other than through the expiration of terms shall be filled in the same manner as the original appointment. Members may be removed for cause by a majority vote of the council. Members shall be selected without respect to political affiliation and may receive such mileage and per diem compensation as is provided by the council. Commission members shall be entitled to no additional mileage or per diem compensation.

The planning and zoning commission shall elect a chairman and create and fill any other office that it may deem necessary. The commission may establish subcommittees, advisory committees, hearing examiners or neighborhood groups to advise and assist in carrying out the responsibilities. The commission may appoint nonvoting ex officio advisors as may be deemed necessary.

Written organization papers or bylaws consistent with the zoning regulations of this Code and other laws of the state for the transaction of business of the planning and zoning commission shall be adopted. A record of meetings, hearings, resolutions, studies, findings, permits and actions taken shall be maintained. All meetings and records shall be open to the public. At least one (1) regular meeting shall be held each month for not less than nine (9) months in a year. A majority of voting members of the commission shall constitute a quorum.

With approval of the city council, the planning and zoning commission may receive and expend funds, goods and services from the federal government or agencies and instrumentalities of state or local governments or from civic and private sources and may contract with these entities and provide information and reports as necessary to secure aid. Expenditures by the commission shall be within the amounts appropriated by the council.

Within such limits, the commission is authorized to hire employees and technical advisors, including, but not limited to, planners, architects and legal assistants.

For the purpose of the zoning regulations of this Code, the planning and zoning commission shall have the following duties:

A.

Initiate proposed amendments to said zoning regulations and conduct a biannual review of the complete zoning regulations.

B.

Review all proposed amendments to said zoning regulations and make recommendations to the council.

C.

Review all planned unit developments and make recommendations to the council.

D.

Grant special use permits as specified in the official schedule of district regulations (see section 5-3-2 of this Code) and under the conditions as herein specified, such additional safeguards as will uphold the intent of said zoning regulations.

E.

Hear and decide appeals where it is alleged there is an error in any order, requirement, decision, interpretation or determination made by the director (see section 5-1-5 of this Code).

F.

Authorize such variances from the terms of the zoning title as will not be contrary to the public interest where, owing to the special conditions, a literal enforcement of the zoning title will result in unnecessary hardship, and so that the spirit of said zoning title shall be observed and substantial justice done.

G.

In the absence of an active design review committee, assume the capacities of this role to carry out the provisions of Kuna City Code title 5 chapter 4.

The city council shall provide that the area and interests within its jurisdiction are broadly represented on the planning and zoning commission. A member or employee of the council or commission shall not participate in any proceeding or action when the member or employee or his employer, business partner, business associate or any person related to him by affinity or consanguinity within the second degree has an economic interest in the procedure or action. Any actual or potential interest in any proceeding shall be disclosed at or before any meeting at which the action is being heard or considered. A knowing violation of this section shall be a misdemeanor.

SECTION:


The design review committee shall function on behalf of the planning and zoning commission and city council. The committee shall be composed of six (6) voting members. Members shall be appointed by the mayor and confirmed by the city council. Members of the committee shall be appointed with proper representation from such fields as architecture, landscape architecture, business, engineering, and a citizen at large.

The members of the committee shall take office as of the date of their appointment, confirmation, and qualification. The term of the appointment shall be for three (3) years. No person shall serve more than three (3) full consecutive terms (9 years). All members shall be eligible for reappointment. In the event of a vacancy of a position on the committee, the mayor shall appoint a new member, with the consent of the city council, for the balance of the unexpired term.

The committee shall elect a chairman from its membership and shall adopt the public hearing procedures as outlined in section 1-6-8 of this Code. The committee shall designate its meeting date for each calendar month; after which time, unless a holiday occurs on that date, the meeting shall be rescheduled to the next regularly scheduled meeting date. At least one (1) regular meeting shall be held each month for not less than nine (9) months in a year. A majority of voting members of the committee shall constitute a quorum.

The chairman shall designate a secretary to keep the minutes of all official meetings. All meetings shall be open to the public. Minutes shall be typed by the city clerk or designee, with copies approved at the next regularly scheduled meeting. All committee documents shall be made available to the public subject to the public records laws.

It shall be the responsibility of the committee to protect property rights and values, enhance important environmental features of the city, and to ensure that the general appearance of buildings and structures, along with development of the land, shall not impair or preclude the orderly and harmonious development of the community.

The committee shall review all development proposals within the design review district. The design review committee's decisions shall be binding on the applicant's proposal unless timely appealed according to section 5-4-11 of this Code and scheduled in accordance with title 5, chapter 1, article A of this Code to the city council. Within this district, the committee, with input from the director, shall regulate landscaping and beautification laws, review building design, and review site planning, signs, grading, development. This includes, but is not limited to, the regulation and restriction of the type of building, number of stories, size of building, construction, reconstruction, alteration, repair, or use of buildings and structures. The committee shall ensure compliance with the requirements of the respective design review overlay districts, City of Kuna Comprehensive Plan, and relevant ordinances.

SECTIONS:


The arts commission will serve in an advisory capacity to the city council and will be named the Kuna Arts Commission.

There shall be no fewer than three (3) and no greater than five (5) members of the Commission, who are appointed by the mayor, subject to the consent of the city council at the first city council meeting in January, for a term of one (1) year commencing at the first quarterly meeting of the commission in January of each calendar year.

The city clerk or the city clerk's designee will staff the commission to provide the committee with needed information for its review and to provide compliance with the open meeting law [Chapter 2 of Title 74 Idaho Code].

To promote, sustain and cultivate public art through the display of art pieces throughout the city at selected public locations, review the conceptual design and placement of artwork; solicit public comment and provide a recommendation to the city council on the design and location of artwork and perform other duties as may be requested from time to time by the city council.

A.

The Kuna Arts Commission shall at its first meeting in January of each year select its officers, which include a chairman, vice chairman and a second vice chair of the committee.

B.

The chairman shall conduct the meetings of the Kuna Arts Commission. The duties of the chairman shall be performed by the vice or second vice chairman in the absence of the chairman or as delegated by the chairman. The chairman and the vice and second vice chairman shall be members of the commission.

C.

The city clerk or city clerk's designee shall serve as the secretary of the committee and shall take minutes and post agenda notices required by the open meeting law. The secretary is not a member of the commission.

D.

The Kuna Arts Commission shall establish a minimum of quarterly meetings scheduled at its first meeting in January of each year, determination to include the dates, time and place of such meetings.

E.

The agenda of each meeting shall include the approval of the minutes of the last meeting.

F.

Fifty-one percent (51%) of the membership of the Kuna Arts Commission shall constitute a quorum. Once a quorum is established for a meeting, the subsequent absence of a member present for creating the quorum shall not dismiss the quorum.

G.

A majority vote of those present at any meeting is sufficient to carry motions.

H.

The Kuna Arts Commission reports directly to the city council of the City of Kuna through the city clerk.

SECTION:


The Kuna Economic Development Executive Committee will serve in an advisory capacity to the city council and will be named the Kuna Economic Development Executive Committee (the "committee").

There shall be no fewer than five (5) and no greater than nine (9) members of the committee, who are appointed by the mayor, subject to the consent of the city council at the first city council meeting in January, for a term of one (1) year commencing at the first meeting of the committee each calendar year.

The economic development director and the city clerk or the city clerk's designee will staff the committee to provide the committee with needed information for its review and to provide compliance with the open meeting law [Chapter 2 of Title 74 Idaho Code].

To serve in an advisory capacity under the direction of the city's economic development director and the mayor in matters related to trade, commerce and industry of this community:

A.

Business recruitment, retention and expansion;

B.

Marketing and public relations;

C.

Talent recruitment and retention;

D.

Support of entrepreneurship; and

E.

Perform other related duties as may be requested from time to time by the economic development director or the mayor.

A.

The committee shall at its first meeting, which shall be called and set by the city's economic development director, shall organize and select a vice chairman of the committee.

B.

The economic development director shall serve as the chairman who shall conduct the meetings of the committee. The duties of the chairman shall be performed by the vice chairman in the absence of the chairman or as delegated by the chairman.

The city clerk or city clerk's designee shall serve as the secretary of the committee and shall take minutes and post agenda notices required by the open meeting law. The secretary is not a member of the committee.

D.

The committee shall establish a meeting schedule at its first meeting each year, determination to include the dates, time and place of such meetings.

E.

The agenda of each meeting shall include the approval of the minutes of the last meeting and the secretary shall provide a copy of the approved minutes to the city council.

F.

Fifty-one percent (51%) of the membership of the committee shall constitute a quorum. Once a quorum is established for a meeting, the subsequent absence of a member present for creating the quorum shall not dismiss the quorum.

G.

A majority vote of those present at any meeting is sufficient to carry motions.

H.

The committee reports directly to the city's economic development director.

SECTION:


A.

Committee created. A standing committee of the city council of the city is established.

B.

Committee name. The standing committee is known and shall continue to be known and designated as the "City of Kuna Development Impact Fee Advisory Standing Committee" [hereinafter in this chapter referred also as "advisory committee" or "committee"].

C.

Membership. The advisory committee established during the preparation of capital improvements plans shall continue in existence and new appointments and reappointments of members of this committee on and after July 1, 2021 shall reside in the City of Kuna. Members shall be appointed by the city council of the City of Kuna for a term of one (1) year or until someone is appointed in his/her place. and there shall not be fewer than five (5) members of which two (2) or more members shall be active in the business of development, building or real estate and two (2) or more members shall not be in the business of development, building, or real estate. Employees or officials acting in their official capacity for a governmental entity, may not be appointed as members of the committee.

1.

The members will be appointed during the January regular meeting of the city council.

2.

Any vacancy on the committee, during the year, shall be filled by appointment by the city council.

D.

Charge. The advisory committee shall serve as an advisory committee to the city council and is charged in relation to this chapter with the following responsibilities:

1.

Assist the city in adopting land use assumptions; and

2.

Review the capital improvements plan; and

3.

Propose amendments, and file written comments; and

4.

Monitor and evaluate implementation of the capital improvements plan; and

5.

File with the administrator and the city clerk, at least annually, with respect to the capital improvements plan a report of any perceived inequities in implementing the capital improvements plan or imposing the City of Kuna a development impact fee; and

6.

Advise the city council of the need to update or revise land use assumptions, capital improvements plan and City of Kuna development impact fees; and

7.

The city shall make available to the advisory committee, upon request, all financial and accounting information, professional reports in relation to other development and implementation of land use assumptions, the capital improvements plan and periodic updates of the capital improvements plans.

E.

Advisory committee organization. The administrators, shall staff the advisory committee in order to provide the committee with needed information for the committee's review and to provide for its compliance with the Open Meeting Law [Chapter 2 of Title 74 Idaho Code].

The advisory committee shall select its officers, which include a chairman, vice chairman and a secretary of the committee.

2.

The chairman shall conduct the meetings of the committee. The duties of the chairman shall be performed by the vice chairman in the absence of the chairman or as delegated by the chairman. The chairman and the vice chairman shall be members of the committee.

3.

The administrator shall serve as the secretary of the committee and shall take minutes and post agenda notices required by the Open Meeting Law. The Secretary is not a member of the committee.

4.

The committee shall establish a regular meeting schedule.

5.

The agenda of each meeting shall include the approval of the minutes of the last meeting and the secretary shall provide a copy of the approved minutes to the city council.

6.

Fifty-one percent (51%) of the membership of the committee shall constitute a quorum. Once a quorum is established for a meeting, the subsequent absence of a member present for creating the quorum shall not dismiss the quorum.

7.

A majority vote of those present at any meeting is sufficient to carry motions.

F.

Reporting. The advisory committee reports directly to the city council.

G.

City council review of committee's reports and recommendations. The city council shall consider the advisory committee's recommended revision(s) at least once every twelve (12) months. The advisory committee's recommendations and the city council's actions are intended to ensure that the benefits to a development paying City of Kuna development impact fees are equitable, so the City of Kuna development impact fees charged to the development shall not exceed a Proportionate Share of System Improvements Costs, and that the procedures for administering City of Kuna development impact fees remain efficient.

SECTION:


Any city development impact fee advisory committee, established by an intergovernmental agreement under I.C. § 67-8204A, is a permanent standing committee of the city. It operates in accordance with the terms of the intergovernmental agreement and any amendments made between the city and the other party to the intergovernmental agreement.
