1-10-3: EXCLUSIONS:
Subject to the limitations set forth in section 50-225, Idaho Code, the boundaries of the city may be altered and any territory included therein may be excluded by ordinance of the city council on its own motion or upon the written petition of any owner or proprietor of lands included in the territorial limits of the city upon the reasonable showing that the exclusion will not interfere with the orderly development of the city and the rights, obligations and duties of other land owners and the residents of the city. Should any lands be so excluded, a copy of the ordinance, certified by the city clerk, shall be filed as provided in section 63-2215, Idaho Code for the county recorder and county assessor within ten (10) days following the effective date of the ordinance.
