7-1G-4: IWUI CODE AMENDMENTS:

IWUI Section 101.1 is amended to read as follows:

101.1 Title. These regulations shall be known as the Wildland-Urban Interface Code of the City of Eagle, hereinafter referred to as "this code."

IWUI Section 103.1 is amended to read as follows:

103.1 Creation of enforcement agency. The City of Eagle Building Department is hereby created and the official in charge thereof shall be known as the code official.

IWUI Section 108.5 is amended to read as follows:

108.5 Fire Protection Plan. (Commonly referred to as a Wildfire Safety and Mitigation Plan)

Where required by the code official pursuant to Section 405, a fire protection plan shall be prepared by a Certified Wildfire Mitigation Specialist or a Fire Protection Engineer and shall be submitted to the code official for review and approved as a part of the plans required for a permit. The Fire Protection Plan shall be incorporated into the CC&Rs and development approvals for subdivisions to ensure adherence to these requirements.

Additionally, the code official may require lots or land that abut or are contiguous to the Wildland Urban Interface Overlay District to have a Wildfire Safety and Mitigation Plan.

IWUI Section 110.4.7 is amended to read as follows:

110.4.7 Violations and Penalties. Persons who shall violate a provision of this code or shall fail to comply with any of the requirements thereof or who shall erect, install, alter, repair or do work in violation of the approved construction documents or directive of the code official, or of a permit or certificate used under provisions of this code, shall be guilty of a misdemeanor, punishable as provided in Eagle City Code Section 1-4-1 (A). Each day that a violation continues after due notice has been served shall be deemed a separate offense.

IWUI Section 114.4 is amended to read as follows:

114.4 Failure to Comply. Any person who shall continue any work after having been served with a stop work order, except such work as that is directed to perform to remove a violation of unsafe conditions, shall be guilty of a misdemeanor, punishable as provided in Eagle City Code Section 1-4-1 (A). Each day that a violation continues after due notice has been served shall be deemed a separate offense.

IWUI Section 602.1 is amended to read as follows:

602.1 General.

An approved automatic sprinkler system may be required to be installed by the code official in all occupancies in new buildings required to meet the requirements for Class 1 ignition-resistant construction in Chapter 5. The installation of the automatic sprinkler systems shall be in accordance with nationally recognized standards.

IWUI Appendix B is amended to read as follows:

Appendix B

B101.2 Plan content.

Vegetation Management: This section shall describe all actions that will be taken to prevent a fire from being carried toward or away from the structure(s), and shall include at least the following information:

1.   Methods and timetables for controlling, changing or modifying areas on the property to create and maintain defensible space. Elements of the plan shall include removal of slash, snags, vegetation that may grow into overhead electrical lines, other ground fuels, ladder fuels and dead trees, and the thinning of live trees, landscaping plans, etc.

2.   A plan for maintaining the proposed hazardous fuel-reduction and mitigation measures.

3.   Maintenance and Cost: The Vegetation Management Plan shall be incorporated into the CC&Rs and development approval(s) for subdivisions to ensure adherence to these requirements. The CC&Rs shall also include a funding mechanism for the continued long-term maintenance and implementation of the Vegetation Management Plan. The cost of plan preparation and review shall be the responsibility of the landowner.

4.   Audits: Each property or development may be subject to an audit every five (5) years to ensure that they are in compliance with their approved Vegetation Management Plan by the City of Eagle. The cost of any audits shall be the responsibility of the landowner. If it is determined by the City that improvements are needed to mitigate wildfire risk, those costs shall be the responsibility of the landowner. If the landowner does not take action to complete the necessary improvements within sixty (60) days, the City or a duly authorized representative may complete the necessary improvements at cost to the landowner.

5.   Qualifications: The Vegetation Management Plan shall be prepared by a Certified Wildfire Mitigation Specialist or Fire Protection Engineer.

6.   Changes: Any vegetation management changes after certificate occupancy will be required to resubmit any changes of any landscape vegetation to the CC&R board to verify compliance with this code. (Ord. 947, 8-12-2025)
