4-5-9: ANIMALS PRESENTING AN IMMEDIATE DANGER:

4-5-9: ANIMALS PRESENTING AN IMMEDIATE DANGER:
   A.   If an animal:
      1.   Presents an immediate danger to the health and safety of a person;
      2.   Is threatening a person; or
      3.   Is harming a person;
Then the animal may be restrained by whatever humane means necessary and even destroyed if absolutely necessary to prevent injury to the victim. Alternatively, a law enforcement officer, the Animal Control Officer or Animal Control Agency may, if practical, apprehend the animal and impound it.
   B.   Any owner of an animal presenting an immediate danger without provocation, as described above, in addition to any other penalties as provided in this Chapter, shall be guilty of a misdemeanor. (Ord. 922, 4-24-2024)
