BY THE COUNCIL   CORLESS, HALLYBURTON, MORALES, NASH, STEAD AND WILLITS.--
AN ORDINANCE ADOPTING AN UPDATED 2026 REIMBURSEMENT RATE SCHEDULE PURSUANT TO THE FOURTH AMENDED SOLID WASTE FRANCHISE AGREEMENT (FRANCHISE AGREEMENT) BY AND BETWEEN THE CITY OF BOISE CITY, BY AND THROUGH ITS PUBLIC WORKS DEPARTMENT (THE CITY), AND ALLIED WASTE SERVICES OF NORTH AMERICA L.L.C. DOING BUSINESS AS REPUBLIC SERVICES OF BOISE (REPUBLIC SERVICES), TO INCREASE REIMBURSEMENT RATES PAID TO REPUBLIC SERVICES FOR SOLID WASTE COLLECTION AND DISPOSAL SERVICES; PROVIDING FOR A WAIVER OF THE READING RULES; AND PROVIDING AN EFFECTIVE DATE.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF BOISE CITY, IDAHO:
Section 1.   That the updated 2026 reimbursement rate schedule, attached hereto, is hereby incorporated by reference as Exhibit B to the Fourth Amended Solid Waste Franchise Agreement (Franchise Agreement) by and between the city of Boise City and Allied Waste Services of North America L.L.C., replacing the prior exhibit, under the “TERMS AND CONDITIONS”, Section 23. Modifications to Reimbursement., Subsection C.
Section 2.   That this Ordinance shall be in full force and effect after its passage, approval and publication, and that Republic Services of Boise reimbursement rate increase will be effective retroactively to January 1, 2026, to align with the contract calendar year.
Section 3.   That pursuant to the affirmative vote of one-half (1/2) plus one (1) of the members of the full Council, the rule requiring two (2) separate readings by title and one (1) reading in full be, and the same is hereby, dispensed with, and accordingly, this Ordinance shall be in full force and effect immediately upon its passage, approval and publication.
