BY THE COUNCIL CORLESS, HALLYBURTON, MORALES, NASH, STEAD AND WILLITS.--
AN ORDINANCE REPEALING BOISE CITY CODE TITLE 3, CHAPTER 22, SHORT-TERM RENTALS; PROVIDING FOR A WAIVER OF THE READING RULES; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, because there are more than two thousand (2,000) short-term rentals advertised for rent within the city of Boise City (“City”), and such rentals have frequent turnover in guests, and in some instance in Idaho, such rentals have been operated in a manner that has resulted in great bodily harm to the guests and public disturbances interrupting the peace of residential neighborhoods, the City adopted Ordinance 7-22 on March 18, 2022, to protect the health, safety, and welfare of short-term rental guests and the neighborhoods in which they’re located; and,
WHEREAS, pursuant to Idaho House Bill 583, which was signed into law by the Governor on March 16, 2026, local authorities are expressly preempted from regulation of short-term rentals in several key areas - i.e., the City is prohibited from requiring a license, fee, permit, certification, or registration to operate a short-term rental and restricts the ability to impose regulations that differ from those applied to similar residential uses; and,
WHEREAS, the City must repeal its short-term rental business license and associated fee from its code to align with state code, and thus, desires to repeal Ordinance 7-22, entitled “Short-Term Rentals.”
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF BOISE CITY, IDAHO:
Section 1. That existing Boise City Code Title 3, Chapter 22, entitled “Short-Term Rentals,” shall be, and hereby is, repealed and stricken from Boise City Code.
Section 2. That pursuant to the affirmative vote of one-half (1/2) plus one (1) of the members of the full Council, the rule requiring two (2) separate readings by title and one (1) reading in full be, and the same is hereby, dispensed with, and accordingly, this Ordinance shall be in full force and effect immediately upon its passage, approval, and publication.
