MUNICIPAL COURT-MAGISTRATE JURISDICTION-DUTIES

SECTION 57. 1. The judicial power of the city shall be vested in a municipal court and the judge thereof, to be known as the city magistrate, who shall be not less than thirty years of age at the time of his appointment, and a qualified elector of the city for three years immediately preceding such appointment.

2.   The municipal court shall always be open for the transaction of business, except on legal holidays. The judge thereof shall have the power to enforce due obedience to all orders, rules, judgments and decrees made by him, and may fine or imprison for contempt offered to such judge while holding his court, or to process issued by him, in the same manner and to the same extent as the district court.

3.   The municipal court shall have exclusive jurisdiction in all matters of violations of the city ordinances. It shall have original jurisdiction of all actions brought to recover or enforce any forfeiture or penalty declared by any city ordinance, where the amount involved does not exceed $500.

4.   The salary of the city magistrate shall be his only compensation for services rendered in that office. All fees or compensation received by him the conduct of his office other than such salary shall be by him accounted for at the end of every month, to the city auditor, and paid over to the city treasurer.

5.   Appeals may be taken and shall be allowed from final judgments rendered in the municipal court in all actions, in the same manner and with like effect, that appeals may be taken and shall be allowed from final judgments rendered in justices' courts.
