AIRPORTS-OPERATION-MAINTENANCE-REGULATION
SECTION 42-D. Boise City, acting by its mayor and common council, shall have power:
1. To improve, maintain, operate, manage and control any and all such aviation fields, airports and real and personal property used therefor or in connection therewith as are now or hereafter owned or possessed by Boise City;
2. To construct or otherwise acquire, install, own, hold, operate, maintain, manage and control on, adjacent to, or in connection with such aviation fields, airports, or property used therefor or in connection therewith, such hangars, repair shops, depots, gasoline stations, buildings and other structures and such equipment as may be necessary or convenient for the operation or maintenance of such aviation fields or airports;
3. To make and enforce ordinances, rules or regulations for the operation, management, regulation, control and use of all such aviation fields, airports, hangars, repair shops, depots, gasoline stations, buildings, structures, improvements, equipment and other property as are above mentioned, and to establish, charge and collect fees or rentals for the use of the same or any part thereof;
4. To make contracts granting rights to the use of such aviation fields and airports, together with the lighting systems and similar equipment therefor, for aviation purposes in common with other users;
5. To lease for aviation purposes or purposes connected with or incidental thereto, the hangars, hangar space, repair shops, depots, gasoline stations, buildings and similar property belonging to or possessed by Boise City and used in connection with such aviation fields or airports; and,
6. To lease such parts of said aviation fields, airports and the real estate used therefor or in connection therewith, as the mayor and common council may deem advisable for the construction, maintenance, operation and/or occupancy of hangars, repair shops, passenger and freight depots, gasoline stations, restaurants, refreshment stands or for similar purposes connected with or incidental to the maintenance and operation of such aviation fields and airports.
Contracts and leases made under one or more of subdivisions 4, 5 and 6 hereof shall be made for such rental or other consideration and for such length of time and upon such other terms and conditions as said mayor and common council in their discretion may determine, provided, however, that with the exception of rights granted by lease under subdivisions 5 and 6 hereof, no right to the exclusive use of any airport, aviation field or other property above mentioned or any part thereof shall ever be granted or created, nor with the exception of property leased under subdivisions 5 and 6 hereof shall the possession, management, operation or control of such aviation fields, airport, or other property or any part thereof be transferred or surrendered by the city to anyone.
