SEWER DISTRICTS

SECTION 42(35). To construct, or cause to be constructed, or otherwise acquire or secure the use of, sewers, or sewage, or trash, or garbage collection or disposal facilities, or any one or more thereof alone or in combination; to locate the same wholly or in part within or without the city; to organize special improvement districts therefor covering the whole or parts of the city; to include within such districts lands outside of and within five miles of the city boundaries which may be served or benefited thereby and where in the opinion of the common council, the protection of the health of the city requires; to provide for the payment of the expense thereof by levy of special assessments upon the properties within such districts which are specially benefited thereby, or by special tax levy; or by the issuance of general obligation bonds as hereinafter provided, or by a combination thereof; to produce and sell by-products of or by such facilities; to maintain, operate, enlarge, extend, and repair such facilities, and therefor to levy and collect special taxes upon properties within the city and to charge and collect periodic service charges against properties outside the city served thereby; to fix, charge and collect reasonable periodic service charges for the service rendered by such facilities, whether heretofore or hereafter constructed, against owners or occupants of property served or capable of being served thereby, or against such property; to provide methods for collection, and penalties, including denial of service, for nonpayment of such charges, and for reinstatement charges, and including certification of delinquent payments to the tax collector and when so certified the same shall be a lien against the property, and collectible as other taxes; to cooperate or contract with other districts, municipalities, organizations or persons for the construction, use, maintenance, operation or repair of such facilities of or by such districts, municipalities, organizations or persons; to license or permit the connection of such facilities by, or the use of service to, properties not within the limits of a district or the city provided there be paid on behalf of such property a fair amount in relation to original construction costs of such facility, and a periodic service charge for maintenance, repair and operation of such facilities or service.
