7-7D-5: EXCEPTIONS FOR EMINENT DOMAIN:
This article 7-7D shall not apply to any successful eminent domain proceeding in a court of competent jurisdiction or any other final order from a court of competent jurisdiction provided, however, that the City takes action to oppose such condemnation and participates in the defense of such eminent domain proceedings in all administrative and trial court proceedings related to such condemnation.
