3-11-7: APPLICATION REQUIREMENTS; TIMING; CONDITIONS; ONGOING DUTY; DETERMINATION OF APPROPRIATENESS; DECISION; PERMIT FEES; AND PERMIT NONTRANSFERABLE:
3-11-7: APPLICATION REQUIREMENTS; TIMING; CONDITIONS; ONGOING DUTY; DETERMINATION OF APPROPRIATENESS; DECISION; PERMIT FEES; AND PERMIT NONTRANSFERABLE:
A. Required: All applications for valet parking permits shall be made to the City Clerk's Office as set forth in section 3-1A-6 of this title.
B. Additional Application Information Required: All permit applications shall additionally require the following information:
1. A copy of the valet parking plan, including a signed statement or agreement by the owner or lessee of any location or facility designated that shall be used as the valet parking location;
2. The sponsor's name, mailing address, phone number, email address, and the location of the sponsor's property or site seeking valet services;
3. A signed statement from the sponsor that includes the following information:
a. A detailed explanation of the need for valet parking services for the sponsor's business operation at the sponsor's property;
b. An explanation and any documentation demonstrating any unique constraints to the sponsor's property or business operation causing the need for valet parking services;
c. An explanation demonstrating how the proposed valet parking service at the sponsor's property would benefit the public's health, safety, and welfare, particularly that of pedestrian and non-motorized vehicle operators;
d. An estimation of the number of parking spaces the sponsor's property would need daily, and if certain hours/days would require more parking capacity, and an explanation of how such estimation was made.
4. A parking assessment that included the following information:
a. The number of on-site parking spaces at the sponsor's property;
b. The available off-street parking options in the near vicinity of the sponsor's property available to the sponsor for its business use;
c. The availability of any on-site area of the sponsor's property that could serve as a valet parking zone and explanation of its use;
d. A demonstration of any clear deficit of on-site or reasonably nearby parking to the sponsor's property;
e. Identify options and feasibility of alternative valet parking zones and valet parking locations for the sponsor's property.
5. The hours of operation and the minimum number of employees the operator engaged for the valet parking operation at the specific property;
6. The name, physical address, email address, and telephone number where the applicant or their employee or agent will be available at all times during hours of operation;
7. The routes to be used by valet attendants between the valet parking zone and the valet parking location, and back;
8. A copy of a written contract, license, or lease between the valet parking service sponsor or operator, and the operator of any parking facility or storage area designated as the valet parking location, which contract or covenant shall contain a provision that it cannot be canceled without at least thirty (30) days written notice to the other non-terminating party and the City; and
9. The location of any proposed signs or attendants' stands.
10. An acknowledgment that every employee who may drive a valet customer's car on behalf of the applicant must have a valid State driver's license.
C. Permit Application Timing: In addition to the application requirements set forth herein, all applications shall adhere to the timing requirements as follows:
1. Regular Valet Operation Permit Applications: All regular valet operation permit applications must be fully completed and submitted to the City Clerk's Office at least thirty (30) business days prior to the proposed commencement of operation.
2. Temporary Valet Operation Permit Applications: All temporary valet parking permits must be fully completed and submitted at least ten (10) business days prior to the proposed commencement of operation.
Failure to comply with application timing requirements may result in delays in processing and permit issuance, delay or interrupt valet operations, or result in loss of hotel limitation exemption.
D. Permit Conditions: Permits will contain conditions to protect public safety, to protect the public's right to equal access to public property, and to ensure noninterference with normal pedestrian or vehicle traffic flow. Any application may be denied, and any permit revoked if the City determines at any time that these conditions have not been or cannot be met.
E. Insurance: No valet operator permit, or renewal thereof, shall be issued unless the applicant provides proof to the City Clerk's Office that they have obtained the required liability insurance coverage as set forth in this chapter.
F. Ongoing Duty To Update: Every applicant and permittee shall have an ongoing affirmative duty to update all information provided on the application for a valet permit in the event such information becomes outdated, untrue, or otherwise incorrect within ten (10) business days of such change.
G. Determination Of Appropriateness: The City shall, in its sole discretion, determine the appropriateness of a proposed area for valet parking services. The City shall consult with ACHD to determine any traffic operations, motorist, or traffic safety issues associated with the issuance or continued use of a permit. The City may consult with the Downtown Boise Association or other downtown tenants or landlords in considering the appropriateness of the proposed area. Under no circumstances may a valet parking operation take place in a travel lane or interfere with pedestrian traffic.
H. Application Review And Decision: The Parking Services Office shall review the submitted application and decide whether a permit should be approved in accordance with the provision of this chapter. Based on the findings, the Parking Services Office may approve, partially approve, disapprove, or approve the application subject to standard or special conditions, including, without limitation, standard or special conditions restricting the hours of valet operation. A notice of the decision shall be sent to the applicant.
I. Valet Parking Permit Fees: Every application for a valet operation permit shall be accompanied by a nonrefundable application fee in an amount established by the City Council and listed on the most current Master Fine and Fee Schedule.
J. Valet Parking Zone Fees: The potential lost parking meter revenue and use of downtown parking spaces resulting from a valet parking operation shall be calculated by the Parking Services Office and paid by the permittee prior to the City issuing a permit as follows:
1. Regular Valet Parking Zone Fee: Every Regular Valet Operation applicant shall pay the annual valet parking zone fee, in an amount established by the Boise City Council and listed on the most current Master Fine and Fee Schedule, for each parking space used in that operation's valet parking zone, whether parking meters were used in such parking spaces or not at the time of the application.
2. Temporary Valet Parking Zone Fee: Every Temporary Valet Operation applicant shall pay the daily valet parking zone fee, in an amount established by the Boise City Council and listed on the most current Master Fine and Fee Schedule, for each parking space used in that operation's valet parking zone for the duration of that permit, whether parking meters were in use in such parking spaces or not at the time of the application.
K. Permits Nontransferable: All permits issued under this chapter are nontransferable. (1952 Code § 5-13-06; amd. 2019 Code; Ord. 12-24, 4-30-2024, eff. 7-1-2024)
