10-2-12: EXPENDITURE OF IMPACT FEES:
A. Expenditures: Expenditures of Impact Fees collected shall be made only for System Improvements within the Service Area for which the Impact Fee was collected in accordance with the applicable Capital Improvement Plans.
B. Capital Improvement Plans Reimbursement; Surcharge: A portion of each Impact Fee collected shall be designated as a surcharge for reimbursement of the cost of preparing the Capital Improvement Plans in accordance with Idaho Code § 67-8208. The surcharge shall not exceed the Development's Proportionate Share of the cost of preparing the applicable Capital Improvement Plans.
