8-6-34: ZONING ORDINANCE TEXT AMENDMENT:

   A.   Applicability: This Section applies to any application to amend the text of the Zoning Ordinance.

   B.   Initiation:

      1.   The Board may propose to amend the zoning ordinance text following notice, neighborhood meeting, and public hearing procedures in Sections 8-6-4, 8-6-8, and 8-6-9.

      2.   Any property owner may propose a zoning ordinance text amendment to the Board.

      3.   Zoning ordinance text amendment applications shall be submitted to the Director.

   C.   Completeness: See Section 8-6-5.

   D.   Notice: See Section 8-6-8.

   E.   Decision:

      1.   Staff Review: The Director shall review the application and prepare and send a recommendation for the Commission's review.

      2.   Commission Review: The Commission shall review the application and submit its recommendation to the Board:

         a.   To approve the zoning ordinance text amendment;

         b.   To deny the zoning ordinance text amendment; or

         c.   To approve the zoning ordinance text amendment with suggested changes.

      3.   Board Decision: The Board shall make the final decision:

         a.   To approve the zoning ordinance text amendment;

         b.   To deny the zoning ordinance text amendment; or

         c.   To approve the zoning ordinance text amendment with changes, subject to public notification of the changes per Section 8-6-8.

   F.   Required Findings: The Board shall make following findings to grant a zoning ordinance text amendment:

      1.   The zoning ordinance text amendment conforms with the applicable comprehensive plan;

      2.   The zoning ordinance text amendment is not detrimental to public health, safety, and welfare; and

      3.   For zoning ordinance text amendments within a planned community (PC) base district, the amendment complies with the planned community implementation plan.

   G.   Appeals: See Section 8-6-13.

   H.   Scope Of Approval: The approval of a zoning ordinance text amendment does not directly authorize the development of land. A zoning ordinance text amendment simply changes the Zoning Ordinance regulations.
