8-6-33: ZONING ORDINANCE MAP AMENDMENT:
A. Applicability: This Section applies to any application to amend the Zoning Ordinance Map.
B. Initiation:
2. Any property owner may propose a zoning ordinance map amendment to the Board.
3. Zoning ordinance map amendment applications shall be submitted to the Director.
C. Completeness: See Section 8-6-5.
D. Notice: See Section 8-6-8.
E. Decision:
1. Staff Review: The Director shall review the application and prepare and send a recommendation for the Commission's review.
2. Commission Review: The Commission shall review the application and submit its recommendation to the Board:
a. To approve the zoning ordinance map amendment;
b. To deny the zoning ordinance map amendment; or
c. To approve the zoning ordinance map amendment with suggested changes.
3. Board Decision: The Board shall make the final decision:
a. To approve the zoning ordinance map amendment;
b. To deny the zoning ordinance map amendment; or
c. To approve the zoning ordinance map amendment with changes.
F. Required Findings: To grant a zoning ordinance map amendment, the following findings must be made:
1. The zoning ordinance map amendment conforms with the applicable comprehensive plan;
2. The zoning ordinance map amendment complies with the regulations outlined for the proposed base district, specifically the purpose statement;
3. The subject property shall meet the minimum dimensional standards of the proposed zoning district;
4. The zoning ordinance map amendment shall not cause detriment to public health, safety, and welfare;
5. The zoning ordinance map amendment shall not result in demonstrable adverse impacts upon the delivery of services by any political subdivision providing public services within the planning jurisdiction including school districts; and
6. For zoning ordinance map amendments within a planned community (PC) base district, the amendment complies with the planned community implementation plan.
G. Appeals: See Section 8-6-13.
H. Scope Of Approval: The approval of a zoning ordinance map amendment does not authorize the development of land. A zoning ordinance map amendment allows property owners to apply for permits or actions that are consistent with the zoning district's standards and requirements.
