8-6-32: ZONING CERTIFICATE:

   A.   Applicability: This Section applies to all properties within Ada County.

   B.   Initiation: A zoning certificate application shall be submitted to the Director.

   C.   Completeness: See Section 8-6-5.

   D.   Notice: Not applicable.

   E.   Decision:

      1.   The Director shall review the zoning certificate application and shall:

         a.   Approve the application;

         b.   Deny the application; or

         c.   Approve the application with conditions.

      2.   The Director shall not issue a zoning certificate for any use on a property that violates this Title or on a property that contains structures or uses that violate this Title, with the exception that a zoning certificate may be issued exclusively for the installation of solar panels on any existing detached structure constructed prior to January 1, 2000, or increased in size after January 1, 2000, regardless of its current zoning status. Any zoning certificate secured that violates state or federal law is invalid.

   F.   Required Findings: The application for a zoning certificate shall comply with all applicable requirements of this Title and any applicable, unexpired conditions of a prior approval.

   G.   Appeals: See Section 8-6-13.

   H.   Scope Of Approval:

      1.   No construction or alteration shall commence until the Director issues a zoning certificate. If no structures are involved, no use shall commence until the Director issues a zoning certificate.

      2.   Any application that requires zoning certificate issuance as a condition of approval is complete with zoning certificate issuance. This provision applies to prior approved applications with issued zoning certificates.

      3.   Zoning certificates issued in conjunction with a change of use that are not associated with a building permit expires if the new use does not commence within one year of zoning certificate issuance date.

      4.   The zoning certificate may require inspections and approvals specified in the approval of the application.

      5.   Upon determining that zoning certificate conditions are violated, the Director may require that all further work stop on a project until the violation is remedied.
