8-6-31: VARIANCE:

   A.   Purpose: This Section establishes procedures for variance permits pursuant to Idaho Code Section 67-6516.

   B.   Applicability: The Board may authorize a variance in specific cases that is not contrary to the public interest where exceptional circumstances and literal enforcement of the provisions of this Chapter will result in unnecessary hardship. Variances are subject to conditions and terms established by the Board.

   C.   Initiation: A variance application shall be submitted to the Director.

   D.   Completeness: See Section 8-6-5.

   E.   Notice: See Section 8-6-8.

   F.   Decision:

      1.   The Board shall conduct a public hearing on the variance and shall render its decision after the hearing is closed.

      2.   The Board may, in whole or in part:

         a.   Approve the variance;

         b.   Deny the variance; or

         c.   Approve the variance with conditions.

   G.   Required Findings:

      1.   The Board shall make the following findings to grant a variance:

         a.   The variance shall not grant a right or special privilege that is not otherwise allowed in the base district;

         b.   The variance relieves an undue hardship due to characteristics of the site; and

         c.   The variance shall not cause detriment to public health, safety, and welfare.

      2.   In granting any variance, the Board may prescribe appropriate conditions and safeguards that conforms with this Title.

      3.   Applications for floodplain variance shall comply with the Section 8-2-28 of this Title and are not subject to the regulations of this section.

   H.   Appeals: See Section 8-6-13.

   I.   Scope Of Approval: After a final decision on the variance is rendered, the Director may issue any applicable building permits and/or zoning certificates.
