8-6-29: TEMPORARY USE PERMIT:
A. Purpose: This Section establishes a process to allow temporary uses on a property.
B. Applicability: All properties within the County may apply for a temporary use permit, as a temporary use only, even if the use is not principally permitted within the zoning district. This Section applies to the temporary uses listed below.
1. Temporary uses that require a zoning certificate include:
a. Temporary Signs;
b. Seasonal Stands;
c. Fireworks Stands (see Idaho Code Section 39-2607);
d. Subdivision Model Homes/Real Estate Offices; and
e. Reapplication for an existing permitted temporary use if the permit has not expired or been revoked.
2. Temporary uses that require administrative approval include new applications and reapplications for an expired or revoked permit for:
a. Temporary Living Quarters;
b. Seasonal Events;
c. An existing dwelling, an existing secondary dwelling, or a temporary manufactured home dwelling while building a new single-family dwelling on the same site;
d. A temporary Pit, Mine, Or Quarry within a residential district;
e. An anemometer or similar device.
C. Initiation: A temporary use application shall be submitted to the Director.
D. Completeness: See Section 8-6-5.
E. Notice: See Section 8-6-8.
F. Decision:
1. The Director shall review the temporary use permit and shall:
a. Approve the temporary use permit;
b. Deny the temporary use permit; or
c. Approve the temporary use permit with conditions.
2. The Director shall determine that all conditions of approval are met and that the temporary use conforms with this Section before a zoning certificate is issued.
G. Standards: The Director shall apply the specific use standards listed in this Section and Section 8-4-73 of this Title to review the temporary use.
H. Required Findings:
1. The Director will issue a temporary use only if:
a. The proposed temporary use is not detrimental to the public health, safety, or welfare;
b. The proposed use does not adversely impact the health and safety of surrounding residents or create undue adverse impacts on surrounding properties;
c. The proposed temporary use complies with all applicable County ordinances;
d. The proposed temporary use complies with all applicable federal and state regulations;
e. The proposed temporary use and facilities do not adversely affect or conflict with abutting uses or impede the normal development of surrounding property; and
f. Adequate public and private facilities such as utilities, landscaping, parking spaces, and traffic circulation measures are provided for the proposed temporary use.
I. Appeals: See Section 8-6-13.
J. Scope Of Approval: The approval of a temporary use permit does not authorize the development of land but allows for an approved use for a specified amount of time on a specific property.
