8-6-25: SUBDIVISION PLATS - GENERALLY:
A. Applicability: In addition to the requirements for public hearings in Section 8-6-9, the following are general approval procedures for subdivision review applications. Specific regulations for each type of subdivision review application are prescribed in Sections 8-6-26, 8-6-27, and 8-6-28.
B. Initiation:
1. An application for subdivision review approval is not considered filed until the Director determines that it is complete.
2. Concurrent with the submission of a subdivision review application, required information established in Sections 8-6-26, 8-6-27, and 8-6-28, as applicable, and any additional information required by the Director shall be submitted.
C. Completeness:
1. Generally: Completeness shall comply with Section 8-6-5.
2. Additionally:
a. These standards shall be followed in all subdivisions regulated by this Title.
b. Any proposed subdivision in areas of the County where topographical slopes are greater than twenty-five percent (25%) or where adverse conditions associated with slope stability, erosion, or sedimentation are present, as determined by the County Engineer, shall conform with the additional hillside regulations in Section 8-2-30 as set forth in this Title.
c. Adequate means for eliminating unsuitable conditions must be approved by the County Engineer in order to develop property that has been designated in the applicable comprehensive plan, in the natural features analysis, or elsewhere, as being unsuitable for development because of flood threat, poorly drained areas, high groundwater, steep slopes, rock formation, buried pipelines, or other similar conditions likely to be encountered.
d. The limits of the subdivision shall encompass the full extent of the owner's lot or "contiguous parcels", as defined in this Title.
e. The decision-making body may require modifications where, in its opinion, site planning has not sufficiently addressed the existing natural features.
f. In addition to Section 8-6-5, the Development Services Department shall examine all subdivision applications for compliance with this Title. The application is forwarded to the appropriate decision-making body for consideration. Failure of staff to make specific comments related to application deficiencies does not relieve the property owner from compliance with this Title.
D. Notice: Subdivision applications require noticing pursuant to Section 8-6-8 unless otherwise noted in this Title.
E. Decision:
1. Generally:
a. Subdivision review applications are approved by the decision-making body prescribed in Section 8-6-2.
b. Staff review will occur for all subdivision review applications prior to a final decision by the applicable decision-making body.
2. Decision Types: The decision-making body shall make any of the following decisions for this Section:
a. Approve the application if it complies with all provisions of this Title;
b. Disapprove the application if it fails to comply with this Title; or
c. Approve the application with conditions.
F. Required Findings: The following standards apply to all subdivision applications:
1. No land shall be used for a purpose prohibited by a condition of approval, any plat note required by condition of approval, inscribed on an approved plat, nor shall any land be used that is not in accordance with the regulations of this Title.
2. No building shall be erected, converted, enlarged, reconstructed, or structurally altered or moved for a purpose or purposes prohibited by covenants incorporated as plat restrictions and approved by the Director, Commission, or Board.
G. Appeals: See Section 8-6-13.
H. Scope Of Approval:
1. Generally:
a. Approval of a subdivision review application does not constitute acceptance of the subdivision but authorizes preparation of the final plat unless otherwise noted in this Section.
b. Once public improvements and easements are accepted by the County Engineer, recordkeeping can occur.
2. Modifications. See Section 8-6-12.
