8-6-23: PROPERTY BOUNDARY ADJUSTMENT:

8-6-23: PROPERTY BOUNDARY ADJUSTMENT:
   A.   Purpose: This Section allows parcel line or platted lot line adjustments between existing legal or nonconforming properties.
   B.   Applicability: These regulations apply to adjustments of parcel lines or platted lot lines between existing lots and parcels in Ada County.
   C.   Initiation: Property boundary adjustment applications shall be submitted to the Director.
   D.   Completeness: See Section 8-6-5.
   E.   Notice: A copy of the application shall be submitted to the Ada County Surveyor and Central District Health.
   F.   Decision: The Director shall review the property boundary adjustment and shall:
      1.   Approve the property boundary adjustment; or
      2.   Deny the property boundary adjustment; or
      3.   Approve the property boundary adjustment with conditions.
   G.   Required Findings:
      1.   A property boundary adjustment shall not reduce the property size below the minimum dimensional standards prescribed by this Title, including regulations for individual wastewater treatment systems and wells as set forth in as set forth in Section 8-3-5D of this Chapter.
      2.   If one or more of the properties is nonconforming as to the minimum dimensional standards prescribed by this Title, the property boundary adjustment shall not increase the nonconformity.
      3.   A property boundary adjustment shall not increase the original number of properties.
      4.   A property boundary adjustment shall not change or move any public streets, private roads, easements, or publicly dedicated areas.
      5.   The property boundary adjustment shall not constitute a relocation of a property.
      6.   For platted lots, the property boundary adjustment substantially conforms to the recorded plat.
   H.   Appeals: See Section 8-6-13.
   I.   Scope Of Approval: A property boundary adjustment does not vacate the platted lot lines of a recorded subdivision.
      1.   Tentative Approval Requirements: Upon tentative approval of the application by the Director subject to any applicable conditions of approval and the regulations of Section 8-6-5, the following tasks must be completed within one year:
      2.   Cause the property to be surveyed;
      3.   Before recording, submit draft copies of the record of survey and resulting parcel descriptions to the Director for review;
      4.   Execute and record the record of survey and necessary deeds with the Ada County Recorder to accomplish the approved property boundary adjustments;
      5.   Obtain new tax parcel numbers from the Ada County assessor; and
      6.   Provide copies of the recorded record of survey, recorded deeds, and the new tax parcel numbers to the Director.
      7.   Approval Letter Issuance: The Director shall determine that all conditions of approval are met, and that the property boundary adjustment conforms with this Section before issuing a final approval letter.
