8-6-11: ACCESSORY USES:
A. Purpose: This Section establishes a process for accessory uses and structures on a property.
B. Applicability: All properties within the County may apply for an accessory use permit, as permitted within the applicable zoning district.
C. Initiation: An accessory use permit application shall be submitted to the Director.
D. Completeness: See Section 8-6-5.
E. Notice: See Section 8-6-8.
F. Decision:
1. The Director shall apply the specific use standards listed in Section 8-4-2 of this Chapter and the findings listed in subsection H of this Section to review the accessory use.
2. The applicant and/or owner shall have one (1) year to obtain all necessary permits and obtain a zoning certificate.
3. The Director shall determine that all conditions of approval have been met and that the accessory use is in conformance with this Section before a zoning certificate is issued.
G. Standards: See Section 8-4-2.
H. Required Findings:
1. The proposed use shall not be detrimental to the public health, safety, or welfare. The proposed use shall not adversely impact the health and safety of surrounding residents, nor shall it create undue adverse impacts on surrounding properties;
2. The proposed use is consistent with the applicable comprehensive plan;
3. The proposed use complies with the purpose statement of the applicable base district and with the specific use standards as set forth in this Section and Section 8-4-2;
4. The proposed use complies with the dimensional standards of the applicable base district;
5. The proposed use complies with all applicable County ordinances;
6. The proposed use complies with all applicable state and federal regulations;
7. The proposed use and facilities shall not adversely affect or conflict with abutting uses or impede the normal development of surrounding property;
8. Adequate public and private facilities such as utilities, landscaping, parking spaces, and traffic circulation measures are, or shall be, provided for the proposed use;
9. For private tower structures, the proposed tower complies with any applicable Federal Communications Commission decisions and regulations;
10. For signs, the size, characteristics, location, number of signs, and the sum of the area of all building and freestanding signs on the property conforms to the standards specified in Section 8-3-12.
I. Appeals: See Section 8-6-13.
J. Scope Of Approval: An accessory use permit does not authorize the maintenance of an unlawful use or structure and does not constitute a defense in an action to abate an unlawful use or structure. The Ada County Building Code may require a building permit (see Section 7-2-3 of Ada County Code and the adopted building code).
