8-4-9: BAR; BREWPUB OR DISTILLERY; OR NIGHTCLUB:
A. Generally: The use shall comply with all Idaho Code regulations regarding the sale, manufacturing, or distribution of alcoholic beverages.
B. Separation: See subsection 8-4-1E for measurement standards.
1. No bar, brewpub or distillery, or nightclub shall be located within one thousand feet (1,000') of any religious land use or school property.
2. No bar, brewpub or distillery, or nightclub shall be located within three hundred feet (300') of any residential use.
3. The application shall provide evidence certified by a professional land surveyor licensed in the state of Idaho that the proposed bar, brewpub or distillery, or nightclub conforms to the separation requirements of this subsection A.
C. Outside Activity: For properties abutting a residential district, no outside activity or event shall be allowed on the site.
