8-3-6: FENCES:

   A.   Purpose: This Section provides standards on the types, construction, installation, and uses of fences.

   B.   Clear Vision Triangle: No sight-obscuring fence, hedge, wall, latticework, or screen shall violate the clear vision triangle requirements (see definition in Chapter 8-10) at a street intersection.

   C.   Barbed Wire/Electric Wire: Barbed wire and electric wire fencing shall only be allowed on properties that meet one or more of the following standards:

      1.   The property is a "farm," as herein defined;

      2.   The property is in the RP, RR, or RUT base districts;

      3.   The property has a livestock confinement facility with more than three hundred (300) animals; or

      4.   The use of barbed wire and/or electric wire fencing was allowed as part of an approved use where security fencing was proposed.

   D.   Height In Areas Of Impact: On properties one (1) acre in size or less and located within an area of impact, no fence, wall, latticework, or screen shall be erected over three feet (3') in height within the required front yard plane.

   E.   Height On Lot. Fences, Walls, Latticework, Or Screens:

      1.   Are allowed within or outside of any setback; and

      2.   Shall not exceed a height of six feet (6') above grade on the perimeter boundary or within any required setback area, unless approved by a variance by the Board or as part of an approved use; and

      3.   For a public facility may exceed six feet (6') above grade without a variance but shall not exceed a height of twelve feet (12') above grade.

   F.   Building Permit Required: Fences, walls, latticework, or screens that exceed six feet (6') in height require a building permit with construction drawings prepared by a qualified and licensed engineer or architect in the state of Idaho.

   G.   Maintenance: Any sight-obscuring fence, or wall, latticework, or screen that is required by this Title to protect adjacent properties, said fence, wall, latticework, or screen shall be maintained in good repair.

   H.   Security Fencing: Security fencing that is not associated with an agricultural use, public facility, or a livestock confinement facility, utilizing barbed wire or electric wire, shall only be used as the top section of the fencing and shall be a minimum of six feet (6') above grade.
